1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of The Pear mobile application and website (collectively, the "Service"), operated by Evo Technology Group, LLC ("we," "our," or "us").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

2. Eligibility

You must be at least 18 years old to use The Pear. By using the Service, you represent and warrant that you are of legal age to form a binding contract with us and meet all eligibility requirements.

3. Account Registration

To use certain features of the Service, you may need to create an account. You are responsible for:

  • Providing accurate, current, and complete information during registration
  • Maintaining the security of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account

4. Use of the Service

The Pear is designed to help couples build trust and improve communication. You agree to use the Service only for lawful purposes and in accordance with these Terms.

You may not:

  • Use the Service for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or servers connected to the Service
  • Use the Service to harass, abuse, or harm another person
  • Use the Service without your partner's knowledge or consent
  • Reverse engineer, decompile, or disassemble any aspect of the Service

5. Consent and Transparency

The Pear's transparency features are designed to be used with mutual consent. You acknowledge that:

  • Transparency features must be enabled by both partners
  • Either partner may opt out of transparency features at any time
  • The Service is not intended for surveillance or controlling behavior
  • You are responsible for having open, honest conversations with your partner about using the app

6. Subscriptions and Payments

Some features of the Service may require a paid subscription. By subscribing:

  • You agree to pay all applicable fees and charges
  • Subscriptions automatically renew unless cancelled before the renewal date
  • You may cancel your subscription at any time through your account settings
  • Refunds are provided in accordance with applicable law and our refund policy

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Evo Technology Group, LLC and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission.

8. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

You may also delete your account at any time through the app settings. Upon deletion, your data will be removed in accordance with our Privacy Policy.

9. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind. We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. Use of the Service is at your own risk.

10. Limitation of Liability

To the maximum extent permitted by law, Evo Technology Group, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice before the new terms take effect. By continuing to access or use the Service after those revisions become effective, you agree to be bound by the revised Terms.
